The Federal High Court in Osogbo has granted the request of the All Progressives Congress (APC), Osun State chapter, the leave to serve the Nigerian Army in Abuja the order in a suit filed on the unlawful arrest and detention of members of the party on the eve and day of the August 9 governorship election.
The ex parte motion, brought to serve the originality process in Monday’s court sitting, is outside the jurisdiction and specifically on the first and second respondents, which are the state security service and the Nigerian Army respectively
In a preliminary proceeding presided over by Justice Babs Kuewumi in Osogbo, the Osun State Capital, counsel to the APC asked the court to allow for a service of the order to the Army outside the jurisdiction which the court granted.
After the proceeding, counsel to the applicant, the APC, Mr Abiodun Olaide, told reporters that the applicant had approached the court to seek justice for the unlawful arrest and detention of over 700 members of the party during the August 9 governorship election in the state.
The respondents in the suit filed by the APC are the state security service, the Nigerian Army and the Nigeria police.
The substantive matter has been adjourned to October 22, 2014.
After the August election, the spokesman of the party, Mr Lai Mohammed, had told Channels Television that the party would seek redress over the arrest of its members.
